Please read, print and sign the following agreement.
New Moon Farm CSA Contract/Terms of Agreement (Policies and Conditions)
I appreciate locally grown, organic produce and want to ensure that it remains available in the this area by becoming a participant in the New Moon Farm's Organic Community Supported Agriculture Program. I understand that the farmers, David and Suzanne Ballard, pledge to do their best to provide the fruit, vegetables, flowers and herbs they propose at the times they estimate and of the highest quality possible. However, as a shareholder in both the bounty and the risk, I understand that nature ultimately decides what I will receive and when I will receive it. In the unlikely event of dissolution of the CSA by the operators, refunds would be issued on a pro rata basis within 60 days of date of dissolution.
Furthermore, I understand that:
  • Signup is on a first-come, first-served basis. Once the alloted number of shares are filled, no more will be added, no exceptions.
  • A $150 deposit is required to reserve membership for 2008. This advance reservation fee allows the Farm to prepare for the upcoming season and is refundable only up until February 15th, 2008. (see refund policy below)
  • Completed application and a signed copy of this agreement, along with check made out to Suzanne Ballard (see app.) are required to reserve my share for the 2008 season.
  • Payment(total cost of share+options minus the $150 deposit) is due by March 15, 2008. If paying in 2 installments, half of total balance is due by March 15, 2008 and remainder is due by June 1, 2008.
  • Being dependent on unpredictable spring conditions, CSA tentatively opens on or before April 22 and will run for 30 weeks concurrently, once CSA opens. CSA will not deliver on Friday, July 4, 2008.
  • Egg Share will run for 20 weeks only and must be purchased as an add on to a produce share.
  • Anyone splitting a share must do so on their own. New Moon will not be responsible for payment or distribution when a share is split between any parties. Likewise, New Moon Farm will not be involved in disputes between parties splitting shares.
  • Each member will receive their weekly share in an appropriate container. However, if member cannot be (physically) available when delivery is made, arrangements should be made in advance to leave coolers or access to garage, etc. especially during warm weather. New Moon Farm will not be responsible for damage to goods if no suitable container is provided.

    • DELIVERY - No guarantees of exceptions to any of the following is implied or stated:
  • Deliveries are to be made via planned routes that will not be changed, once CSA opens.
  • Delivery days are Tuesdays and Fridays. Members will receive their share on the same day for the life of their share, based on their location and will receive notification of their specific delivery day once all memberships are filled.
  • There is no charge for delivery within designated delivery area.
  • Deliveries made outside of delivery area will be subject to a $5 surcharge plus 25 cents per mile roundtrip (from the Farm), with a $15.00 maximum fee. No guarantees made as to availability of this service.
  • If a member should occasionally be unable to take delivery of their share, delivery to an alternative location may be considered and would be subject to any applicable surcharges if outside regular delivery area. Minimum of 48 hours notification priot to scheduled delivery is required for alternative location to be considered and approval is not guaranteed.
  • Missed shares (by member) cannot be made up on another date, unless there is an extenuating circumstance. Final decision on approval of make ups is up to, and at the discretion of, the operators.

Refund Policy
*Notification of withdrawal from membership must be made, in writing, no later than Feb. 15th, 2008, no exceptions.
*No refund of deposits will be made after the above date. After that time, member becomes responsible for full payment.
*In lieu of refund, CSA may accept transfer of a share to a new member if member is unable to continue membership.
*No refunds will be made for any missed deliveries unless it is the fault of the operator.
Transfer of Ownership Policy
*If unable to continue with CSA, after the Feb. 15 withdrawal deadline, and transfer of ownership becomes member's only remedy for withdrawal, it is the member's responsibility to find someone to buy out the share.
*CSA must be consulted before consent to sell any share is granted and has final approval over any transfer of membership.
*Any prospective purchaser of the share must fill out the application and sign a copy of this agreement BEFORE transfer will be considered is made.
